Terms of Service

1. Acceptance of Terms

By creating an account or using DayOne ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users including individuals, teams, and organizations.

2. Description of Service

DayOne is an AI-powered learning platform that converts documents, audio, and video into structured micro-learning courses. Features include course generation, interactive learning cards, quizzes, progress tracking, team management, and course sharing. Some features require a paid subscription.

3. Your Account

You are responsible for maintaining the security of your account credentials. You must not share your password or allow others to access your account.

You must be at least 13 years old to use DayOne. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these terms.

You are responsible for all activity that occurs under your account.

4. Your Content

You own your content. Any documents, videos, audio, or other materials you upload ("Your Content") remain yours. We do not claim ownership of your content.

License to process. By uploading content, you grant DayOne a limited license to transmit and process your content through our AI services solely to generate your courses. This license ends when you delete the content or your account.

Your responsibility. You represent that you have the rights to upload the content you provide, and that it does not infringe any third-party rights, violate any laws, or contain harmful material.

No training use. We do not use your content to train AI models.

5. Acceptable Use

You agree not to use DayOne to:

  • Upload content that violates any law or infringes third-party rights
  • Upload content containing malware, viruses, or harmful code
  • Attempt to reverse-engineer, scrape, or abuse the AI generation service
  • Share courses containing harmful, illegal, or deceptive content
  • Circumvent usage limits, paywalls, or authentication
  • Use the service in a way that could harm DayOne or other users
  • Impersonate any person or entity

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

6. Subscriptions and Billing

Free tier. DayOne offers a free tier with limited course generation. No payment is required to start.

Paid plans. Paid subscriptions unlock higher generation limits and team features. Pricing is displayed at dayone.cards/pricing.

Billing. Subscriptions are billed in advance on a monthly or annual basis via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

Cancellation. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time unless required by law.

Trial periods. Free trials are available for new accounts. At the end of the trial, your account will downgrade to the free tier unless you subscribe. We will not charge you without your explicit action.

Price changes. We may change pricing with 30 days' notice to existing subscribers.

7. AI-Generated Content

Courses generated by DayOne are produced by AI and may contain errors, inaccuracies, or omissions. AI-generated content is provided for educational and informational purposes only. You are responsible for reviewing generated content before using it for safety-critical training, compliance, or professional instruction. DayOne is not liable for decisions made based on AI-generated course content.

8. Intellectual Property

DayOne, its logo, design, and technology are owned by us and protected by intellectual property law. You may not copy, reproduce, or create derivative works from our platform without written permission. The Scout mascot, brand assets, and generated UI are proprietary to DayOne.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAYONE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

11. Indemnification

You agree to defend, indemnify, and hold harmless DayOne and its officers, directors, employees, and agents from any claims, damages, liabilities, or expenses arising from your use of the Service, your content, or your violation of these Terms.

12. Termination

You may delete your account at any time from your Profile page. We may suspend or terminate your account immediately if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends. Sections 4, 7, 9, 10, and 11 survive termination.

13. Governing Law

These Terms are governed by the laws of the State of Kansas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Kansas, and you consent to personal jurisdiction there.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance.
